In the context of the regulations regarding copyright and related rights, as well as the information on this subject, publicly disseminated by some state authorities, the Institute for Standardization of Moldova (ISM) specifies:

– ISM represents the national standardization body, recognized throughout the territory of the Republic of Moldova by Law no. 20 of March 4, 2016 regarding national standardization;

– Pursuant to Law no. 20 of 03/04/2016 on national standardization, Moldovan, European, international, interstate and other countries’ standards, including their projects, are considered scientific works within the meaning of Law no. 139 of July 1, 2010 on the right copyright and related rights and are protected by copyright. Copyright on Moldovan standards belongs to the Institute of Standardization of Moldova (ISM);

– ISM is a companion member of the European Committee for Standardization (CEN) and the European Committee for Electrotechnical Standardization (CENELEC);

– As a result of signing the EU-RM Association Agreement, ISM acts towards fulfilling the requirements established by CEN/CENELEC in order to obtain full membership status in these standardization organizations. One of the requirements established by Guideline 22 regarding the organizational structure and processes for the assessment of CEN and CENELEC membership criteria is the protection of copyright (according to criterion 6.4);

– From a legal point of view, this requirement is covered by ISM through national legislation, including legislative acts ratifying international treaties in the field of copyright protection.

– The national standardization rules and the internal procedures of the ISM contain provisions with reference to the protection of copyright, provisions that refer more to the members of the technical committees (transfer of copyright on personal contributions to the development of standards), to the protection signs of commercialized standards (watermark, fiscal code of the natural or legal person who owns it, ISM wet stamp).
